5B acknowledges the Traditional Custodians of the land on which we operate, live and gather as employees and recognise their continuing connection to land, water and community. We pay our respects to Elders past, present and future.
Overview
5B’s mission is to accelerate the planet’s transition to fast, easy, low-cost clean energy by harnessing the full power of the sun. In doing business we are committed to conducting our activities in a sustainable and inclusive manner to deliver the best social and commercial outcomes. We hold ourselves to high ethical standards and behaviors and expect the same of contractors, ecosystem partners, consultants and other stakeholders (‘suppliers’, ‘you’). This Supplier Code of Conduct defines the basic expectations applicable to you, and we require that you comply with (and ensure that your officers, employees, agents and contractors comply with) these expectations when doing business with us.
Comply with laws and regulations
We expect you to comply with all applicable laws, regulations, policies, and the standard of business practice expected of a category leader within their industry, including this Supplier Code of Conduct.
Provide a safe environment
You must comply with all applicable health and safety laws, regulations, standards and appropriate codes of practice in the country where workers are engaged. This includes, but is not limited to, taking reasonable steps to prevent accidents and injury and providing all necessary supervision, training, instruction, equipment, resourcing and information to all employees, and where applicable, provide personal protective equipment for use.
Respect labour and human rights
We expect you to operate workplaces that are free of harassment and discrimination; to pay your employees and contractors on time, comply with local laws and regulations in respect of working hours, wages, superannuation, benefits, leave entitlements, public holidays and compensation insurance for workers. You must ensure employees receive a fair wage that is enough to meet basic needs and to provide some discretionary income, allow overtime to be voluntary, not excessive and paid in accordance with local laws and regulations.
We expect you to not engage any forced, bonded, or involuntary labour (e.g. modern slavery), and ensure only persons with a legal right to work are engaged. You must comply with all applicable child labour laws (UN Principle Five: Labour) and only employ workers who meet the applicable minimum legal age requirement in the country. Children under the age of 18 must not provide labour and services for any hazardous work or work that is inconsistent with the child’s individual development.
You must comply with any applicable requirements under the Modern Slavery Act 2018 (Cth) and take reasonable steps to identify, assess and address risks of Modern Slavery practices in their operations and supply chain. If at any time you become aware of modern slavery practices in your operations or supply chains, please take all reasonable action to address or remove these practices.
Protect the environment
5B is committed to sustainable business practices. We aim to procure goods and services that have the least possible impact on our environment. We expect you to avoid harming, and seek to protect the environment in which you operate. 5B’s approach is to embed environmental management principles within business operations, strive to continuously improve environmental and resource management, and 5B expects all stakeholders to apply the same principles.
Conduct business in an ethical manner
As an integral part of our business operations, we expect you to act ethically and be honest, transparent and trustworthy in dealing with others.
You must not offer or receive gifts, benefits and entertainment that could inappropriately influence, or be perceived to inappropriately influence, the outcome of business transactions or could be perceived to obtain any unfair or inappropriate advantage. You are required to avoid actual, potential or perceived conflicts of interest with 5B stakeholders, as well as not participate or be involved with any type of money laundering and competitive conduct, such as cartel conduct, activities.
Avoid corruption and bribery
You must comply with all applicable anti-corruption laws and regulations. Do not engage in bribes, pay-offs, kickbacks or any other inappropriate benefits, whether directly or indirectly, no matter how large or small in value. When dealing with governments, political parties and public officials, including on our behalf, do that responsibly.
Respect intellectual property
Respect the intellectual and other property rights of 5B and of third parties, including all patents, trademarks and copyrights.
Protect privacy
You must comply with applicable laws and regulations, including General Data Protection Regulation (GDPR) and the Privacy Act 1988 (Cth). Respect the privacy rights and data of 5B employees, customers and suppliers, and implement appropriate controls to ensure security and confidentiality of B5 data to prevent accidental, unauthorised or unlawful destruction, alteration, modification, retention or loss of data or its misuse.
